Terms of Service

1. Acceptance of Terms

By accessing or using the Design Yangu platform ("the Platform"), operated by Yami Designs ("we", "us", or "our") at designyangu.com, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations of the Republic of Kenya. If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all visitors, registered users, designers, and any other persons who access or use the Platform. By completing registration, placing an order, or uploading a design, you confirm that you have read, understood, and accepted these Terms.

2. Description of Service

Design Yangu is a print-on-demand design studio and creator marketplace based in Nairobi, Kenya. The Platform provides:

• An in-browser canvas editor that allows users to create custom graphic designs
• A product catalogue of printable goods including t-shirts, hoodies, mugs, tote bags, phone cases, and posters
• A creator marketplace where designers can upload artwork, set prices, and earn commissions on sales
• Order fulfilment services including printing, quality control, packaging, and delivery within Kenya
• Payment processing via M-Pesa and other accepted methods

3. Eligibility

You must be at least 18 years of age to register for an account or make purchases on the Platform. Persons between 13 and 17 years of age may use the Platform only with verifiable parental or guardian consent. By using the Platform, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

To access certain features of the Platform, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information including your full name, valid email address, and phone number
• Maintain and update your account information to keep it accurate and current
• Keep your password confidential and not share it with any third party
• Notify us immediately at info@designyangu.com if you suspect unauthorised access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate any account we reasonably believe is being misused, has provided false information, or is in violation of these Terms.

5. Intellectual Property Rights

Your Designs: You retain full ownership of all original designs and artwork you create or upload to the Platform. By uploading or creating a design and making it available on the marketplace, you grant Yami Designs a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute your designs solely for the purpose of fulfilling orders, operating the Platform, and promoting Design Yangu. This licence does not transfer ownership of your work to us.

Platform Content: All original content on the Platform, including but not limited to the website design, logos, software, text, and graphics that are not user-generated, remain the exclusive property of Yami Designs and are protected under Kenyan and international intellectual property law.

Prohibited Uploads: You must not upload or create designs that infringe on the copyright, trademark, or other intellectual property rights of any third party. You must not upload designs featuring unlicensed logos, celebrity likenesses, copyrighted characters, or any content that violates these Terms. We reserve the right to remove any content that infringes on third-party rights without notice.

6. Designer Programme

Registered designers who participate in our marketplace agree to the following additional terms:

• Designer commission is set at 70% of the markup you apply above the base product cost. Yami Designs retains 30% as a platform fee.
• Payouts are processed to your registered M-Pesa number or bank account on a weekly basis, subject to a minimum payout threshold of KES 500.
• You are responsible for any applicable taxes on your earnings. We will provide transaction records to support your tax compliance obligations.
• Designs submitted to the marketplace are subject to review and may be rejected if they violate our content guidelines.
• We reserve the right to feature, promote, or remove designs from the marketplace at our discretion.

7. Payments and Pricing

All prices on the Platform are displayed in Kenyan Shillings (KES) unless explicitly stated otherwise. We accept payment via M-Pesa (Safaricom Daraja), debit and credit cards, and other methods listed at checkout. All transactions are processed securely.

Orders are confirmed only upon successful payment. We reserve the right to cancel orders where payment has not been received or where pricing errors have occurred, in which case we will issue a full refund. Yami Designs reserves the right to adjust product pricing with reasonable notice.

8. Orders, Fulfilment, and Delivery

Each product is custom-manufactured after an order is placed. Standard delivery timelines are 3–5 business days within Nairobi and 5–7 business days to other regions within Kenya. These are estimates and may be affected by factors outside our control including public holidays, carrier delays, and weather events.

Delivery is to the address provided at checkout. We are not responsible for failed delivery due to incorrect or incomplete address information provided by the customer. Please review our Returns & Refunds Policy for information on damaged or incorrect orders.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any purpose that is unlawful under the laws of Kenya or any other applicable jurisdiction
• Upload content that is offensive, obscene, hateful, defamatory, or harmful to minors
• Attempt to interfere with, disrupt, or compromise the security or integrity of the Platform or its servers
• Engage in scraping, automated data extraction, or any form of data harvesting without our written consent
• Impersonate another person or entity or misrepresent your affiliation with any person or entity
• Use the Platform to distribute unsolicited commercial communications (spam)
• Attempt to reverse-engineer, decompile, or disassemble any portion of the Platform

10. Limitation of Liability

To the maximum extent permitted by the laws of Kenya, Yami Designs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill. Our total aggregate liability to you in connection with these Terms or your use of the Platform shall not exceed the total amount you paid to us in the twelve months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11. Indemnification

You agree to indemnify, defend, and hold harmless Yami Designs, its directors, employees, partners, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the courts of Kenya sitting in Nairobi.

13. Amendments

We may update these Terms of Service from time to time to reflect changes in our services, business practices, or applicable law. We will notify registered users of material changes via email or through a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the revised Terms.
